21st session: NSS complainant questioned as case moves to witness stage

JUBA – The Special Court hearing the case against eight SPLM/A-IO officials including Dr. Riek Machar, resumed on Friday, with the investigator and the complainant being questioned by the judges, defense and prosecution.

Presiding judge James Alala Deng asked Maj. Gen. Basilio Thomas Wani about how he determined that the 1st and 2nd accused were funding of the White Army, who commanded the militia group and how many of its men died in the Nasir attack.

The prosecution then called the complainant, Richard Apollo, to the stand and questioned him on the intelligence information and evidence gathered by the National Security Service against the accused persons.

Complainant Apollo was afterwards cross-examined by the defense lawyers and the judges.

Apollo testified that most of the accused persons have allegedly mobilized, plotted with and incited the White Army and SPLA-IO to attack the Nasir Garrison.

He said most of the accused were sharing intelligence information on the movement of SSPDF and the White Army activities among themselves through their phone calls, WhatsApp and direct meetings.

When asked to give evidence of incidents of direct meetings and the alleged intelligence sharing, he answered that he did not know and that the witness would testify.

Meanwhile, the defense team submitted its response to the prosecution’s application for witness protection and appointment of a court interpreter.

Defense lawyer Gery Raimondo Legge says they have rejected the prosecution’s application for witness protection because, in his words, it is an intentional plan to avoid presentation of their witnesses.

The 21st session was then adjourned to Monday, November 17, where the prosecution is expected to call its witnesses to testify.
